Terms of Service

1) Eligibility & Location

• You must be 21 years or older and located in the United States to use the Services.
• You may not use the Services where prohibited by law. You are responsible for complying with applicable laws and regulations.

2) Social-Casino; No Real-Money Gambling

The Services are for entertainment only. Virtual coins, credits, points, and similar items (collectively, “Virtual Items”) are not real money, have no cash value, and are not redeemable for cash or cash equivalents.

3) Accounts & Security

• You agree to provide accurate information and keep it current.
• You are responsible for activity on your account and for maintaining the confidentiality of login credentials.
• We may require age and identity verification and may suspend access while verification is pending.

4) Acceptable Use

• No cheating, exploiting bugs, automation/bots, reverse engineering, or interfering with the Services.
• No harassment, unlawful content, or attempts to access other users’ accounts or our systems.
• No buying, selling, gifting, or transferring accounts or Virtual Items except as expressly allowed by us.

5) Virtual Items; Purchases

• Virtual Items are licensed, non-transferable, and may be modified or discontinued.
• If we offer paid Virtual Items, all sales are generally final to the extent permitted by law.
• If you believe a charge is incorrect, contact us promptly at contact@brightfunharbor.com. Do not initiate a chargeback before contacting us; fraud or excessive chargebacks may result in suspension/termination.

6) Intellectual Property

The Services, including software, artwork, text, and trademarks, are owned by Bright Fun Harbor, LLC or its licensors and protected by applicable laws. You receive a limited, revocable, non-exclusive license to use the Services for personal, non-commercial entertainment.

7) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation.

8) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHT FUN HARBOR, LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

9) Termination

We may suspend or terminate access to the Services at any time for suspected violations, security reasons, or operational needs. Upon termination, your license ends and Virtual Items may be forfeited as permitted by law.

10) Disputes; Arbitration & Class-Action Waiver

Except where prohibited, you and we agree to resolve disputes through binding individual arbitration under the Federal Arbitration Act, and you waive the right to participate in a class action or class arbitration. Before filing, you agree to send a written notice of dispute to our address below and attempt to resolve it informally for 30 days. If arbitration applies, it will be conducted by a recognized arbitration provider, and the arbitrator may award relief only on an individual basis. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us with subject “Arbitration Opt-Out” and your account email.

11) Governing Law

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, and applicable U.S. federal law (including the FAA for arbitration).

12) Changes

We may update these Terms from time to time. Continued use of the Services after changes become effective means you accept the updated Terms.
